7. PAYCO REFERRAL SUBMISSION TERMS

These Referral Submission Terms apply when any person or entity submits a prospect, merchant, partner, lead, referral, account, or business opportunity to Payco Enterprises, Inc. DBA Payco. By submitting a referral to Payco, you agree to these Referral Submission Terms.

Submitting a referral to Payco does not create a commission right, residual right, referral-fee right, ownership right, protected account right, agency relationship, partnership, joint venture, or other compensation obligation.

Referral compensation is payable only if Payco has entered into a separate written agreement that expressly provides for compensation.

Payco may already know, be working with, or have previously received the same prospect, merchant, partner, or account.

Payco’s internal records shall control lead source, timing, account attribution, duplicate status, and eligibility unless a signed written agreement provides otherwise.

No referral source, partner, agent, consultant, or third party may bind Payco, quote final pricing, approve accounts, promise savings, guarantee approval, modify Payco agreements, waive Payco rights, or make commitments on Payco’s behalf unless expressly authorized in writing by Payco.

Referral sources must protect Payco’s confidential information, pricing, proposals, client information, underwriting information, program materials, training materials, and business methods.

Referral sources may not disclose, misuse, copy, distribute, or exploit Payco confidential information without Payco’s prior written consent.

Unless otherwise agreed in writing, referral sources may not use Payco’s confidential information, pricing, proposals, contacts, processor relationships, bank relationships, vendor relationships, or program materials to circumvent Payco or interfere with Payco’s business relationships.

Payco may determine, in its sole discretion, whether a referral was validly submitted, whether the referral was already known to Payco, whether the referral was duplicate, whether the referral resulted in a closed account, and whether any compensation is owed under a separate written agreement.

If a separate written agreement exists between Payco and a referral source, that agreement controls over these Referral Submission Terms to the extent of any direct conflict.

No referral submission, email, phone call, text message, meeting, introduction, or course of dealing modifies or waives the Payco Service Agreement unless Payco expressly agrees in a signed written agreement.

8. PAYCO SECURITY STATEMENT

Payco Enterprises, Inc. DBA Payco takes data security seriously and uses reasonable administrative, technical, and organizational safeguards designed to protect information submitted through its website and business systems.

Use of Payco’s website, systems, support channels, equipment, software, implementation services, payment processing services, POS services, IT services, PaaS programs, referral channels, or related business services is subject to the Payco Service Agreement and all applicable Payco policies.

Payco may use reasonable security measures designed to protect information from unauthorized access, disclosure, alteration, misuse, or destruction.

These measures may include administrative controls, technical safeguards, access controls, vendor controls, monitoring, and internal business procedures.

No website, internet transmission, email, SMS message, online form, software platform, payment tool, cloud platform, or storage system can be guaranteed to be completely secure.

Users submit information at their own risk.

Users should not submit sensitive payment card data, passwords, bank credentials, protected health information, Social Security numbers, tax identification documents, or other highly sensitive information through unsecured website forms unless specifically instructed by Payco through an approved secure method.

Some Payco services may involve third-party processors, sponsor banks, gateways, POS providers, software vendors, lenders, cloud providers, CRM systems, and other third-party platforms.

Payco is not responsible for the security practices of third-party websites, portals, tools, applications, or platforms that Payco does not control.

Please include a description of the issue, the page or system involved, the date and time observed, and your contact information.

This Security Statement does not grant permission to scan, test, probe, attack, access, disrupt, reverse engineer, or otherwise interfere with Payco systems, networks, websites, software, accounts, data, or third-party systems.

Any unauthorized testing or access is strictly prohibited.

Payco may update this Security Statement at any time. Updates will be effective when posted to the website unless a different effective date is stated.

9. DO NOT SELL OR SHARE MY PERSONAL INFORMATION

Payco Enterprises, Inc. DBA Payco respects privacy rights and provides this page for users who wish to exercise applicable privacy rights related to the sale or sharing of personal information.

Submitting a privacy request or opt-out request does not modify, waive, cancel, or limit any obligation under the Payco Service Agreement or any other applicable Payco agreement, including payment, equipment, processing, compliance, dispute-resolution, and record-retention obligations.

Payco does not knowingly sell personal information in the traditional sense for monetary compensation.

However, some privacy laws may define “sale” or “sharing” broadly to include certain advertising, analytics, retargeting, or cross-context behavioral advertising activities involving cookies, pixels, or similar technologies.

If applicable law gives you the right to opt out of the sale or sharing of your personal information, you may submit an opt-out request by contacting Payco at support@mypayco.com.

Disabling cookies may affect website functionality.

Payco will not discriminate against you for exercising privacy rights provided by applicable law.
